Terms of Use
These Terms of Use (“Terms”) are a contract between you and DMP LOGISTICS LLC, a New York limited liability company that operates SportsModel AI (“Company,” “we,” “us,” or “our”). They govern sportsmodel.ai and related applications, subscriptions, reports, predictions, probabilities, alerts, and services (collectively, the “Service”).
1. Acceptance and eligibility
By accessing the Service, creating an account, affirmatively accepting these Terms, or purchasing a subscription, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally capable of entering a contract.
2. Informational research only
The Service provides statistical research, model-generated estimates, and entertainment information. It is not a sportsbook, bookmaker, fiduciary, financial adviser, or guarantee of results. Predictions may be inaccurate, incomplete, delayed, or changed. You are responsible for independently verifying information and complying with applicable law.
Do not stake money you cannot afford to lose. If gambling is illegal where you are located, do not use the Service for gambling-related decisions. SportsModel AI does not accept or place wagers.
3. Accounts
You must provide accurate information, protect your credentials, and promptly report unauthorized access. Accounts are individual and may not be shared, sold, transferred, or used to evade access controls. We may require email verification and may suspend access to protect the Service or investigate misuse.
4. Subscriptions, renewal, cancellation, and refunds
Eligible Pro subscriptions begin with a three-day free trial. A payment method is required at checkout. Unless you cancel before the trial ends, the payment method is charged the displayed plan price when the trial expires, and the subscription then renews automatically at the displayed interval until cancellation. Add-ons do not include a separate trial unless checkout expressly states otherwise.
The introductory trial is limited to one per person and payment method. Creating another account, using an alternate email address, or otherwise attempting to obtain an additional introductory trial does not restore eligibility. If you are not eligible, we will disclose that the selected paid subscription is charged immediately and require your express confirmation before opening paid checkout.
You may cancel before the next renewal using the account or billing tools made available to you. Cancellation stops future renewal and ordinarily leaves access available through the paid period. Except where required by law or stated at purchase, fees already charged are nonrefundable. Future prices may change only with legally required notice.
5. Limited license
Subject to these Terms and payment of applicable fees, Company grants you a limited, revocable, nonexclusive, nontransferable license to use the Service for personal or internal business research. No ownership interest is transferred.
6. Prohibited conduct
- Scrape, crawl, harvest, mirror, or systematically extract Service content or data.
- Reverse engineer, decompile, extract models or weights, infer nonpublic features, or conduct model-stealing attacks.
- Use outputs to train, validate, benchmark, or improve a competing model, dataset, or service.
- Resell, republish, sublicense, redistribute, syndicate, or expose outputs as a standalone feed, API, or dataset.
- Circumvent subscriptions, authentication, security measures, or rate limits.
- Share credentials, interfere with operation, infringe rights, or use the Service unlawfully.
- Suggest affiliation with Company, leagues, teams, sportsbooks, OpenAI, or data providers without authorization.
7. Intellectual property
Company and its licensors retain all rights in the Service, including protectable code, text, graphics, models, feature engineering, database selection and arrangement, derived structures, reports, trade secrets, and trademarks. Individual sports facts may not be owned by Company. Third-party names, statistics, marks, and data remain subject to their owners’ rights and applicable licenses. “SportsModel AI” is claimed as a trademark of DMP LOGISTICS LLC.
8. User submissions and feedback
You retain ownership of content you submit. You grant Company a nonexclusive, worldwide, royalty-free license to process it as needed to operate, secure, support, and improve the Service. Voluntary product feedback may be used without restriction or compensation.
9. Third-party services and data
The Service may rely on Supabase, Stripe, Cloudflare, sports-data and odds-data sources, and other providers. Their services may change or be governed by separate terms. NFL historical data may include material from nflverse, used under the Creative Commons Attribution 4.0 International license.
SportsModel AI is independent and is not affiliated with, sponsored by, or endorsed by any professional or collegiate league, team, athlete, sportsbook, broadcaster, or data provider. Third-party names are used only to identify factual sports information. No third-party trademark ownership is claimed.
10. Availability and changes
We may modify features, impose reasonable limits, correct errors, or suspend the Service. We do not guarantee uninterrupted availability, any particular data source, or preservation of historical outputs.
11. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” COMPANY DISCLAIMS EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS MEMBERS, PERSONNEL, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST WAGERS; LOST DATA; OR BUSINESS INTERRUPTION. COMPANY’S AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID COMPANY DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NONWAIVABLE RIGHTS ARE NOT LIMITED.
13. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold Company harmless from third-party claims arising from your unlawful use, breach, infringement, or unauthorized redistribution. This does not require indemnification for Company’s own unlawful conduct.
14. Suspension and termination
We may suspend or terminate access for breach, fraud, security risk, nonpayment, legal requirements, or threats to the Service. Provisions concerning ownership, restrictions, disclaimers, liability, and disputes survive.
15. New York law and forum
New York law governs these Terms, without regard to conflicts rules. Subject to nonwaivable consumer rights, state and federal courts located in Suffolk County, New York have exclusive jurisdiction. Before filing a claim, each party will provide written notice and attempt in good faith to resolve it for 30 days.
16. Changes
We may revise these Terms prospectively. Material changes will be communicated through the Service or account email as required by law.
